Terms of Service

1. Agreement and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and SugarPage, a service of Dual Information Technology Services ("SugarPage", "we", "us", or "our").

By accessing, purchasing, or using any SugarPage services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

This agreement is governed by the laws of the Republic of the Philippines, including but not limited to the Civil Code, the Electronic Commerce Act (Republic Act No. 8792), and the Data Privacy Act of 2012 (Republic Act No. 10173).

2. Services Provided

SugarPage provides the following services:

  • Web Hosting: Shared hosting solutions for websites and web applications
  • VPS Hosting: Virtual Private Server hosting with dedicated resources
  • Domain Registration: Domain name registration and management services

Our hosting infrastructure may be located in data centers outside the Philippines. By using our services, you consent to your data being processed and stored in these locations.

3. Account Registration

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your contact information remains accurate and up-to-date

4. Payment Terms

All fees for our services are due and payable according to the billing terms presented at the time of purchase.

  • Payment is required within two (2) working days from the date of invoice
  • All prices are in Philippine Pesos (PHP) unless otherwise specified
  • We accept payment via credit card, bank transfer, and other methods as indicated on our website
  • Failure to pay may result in suspension or termination of services

Refund Policy: All sales are final. Refunds are generally not provided for any services rendered. However, we may consider refund requests on a case-by-case basis at our sole discretion.

Disputes: Any payment disputes must be raised within thirty (30) days of the transaction date. Fraudulent chargebacks or payment disputes may result in immediate account termination.

5. Service Level Agreement

We strive to maintain high availability for all our services. In the event of unexpected, unscheduled downtime:

  • Service credits may be issued at our sole discretion
  • Credits are applied as account balance and are not redeemable for cash
  • Claims must be submitted within seven (7) days of the incident

Exclusions: The following are not covered by our SLA: scheduled maintenance (with prior notice), third-party service failures, force majeure events, customer-caused issues, or DDoS attacks.

6. Acceptable Use Policy

You agree not to use our services for any unlawful or prohibited activities. The following are strictly prohibited:

  • Illegal activities or content that violates Philippine or international law
  • Distribution of malware, viruses, or malicious code
  • Spam, unsolicited bulk email, or phishing activities
  • Hacking, unauthorized access, or security breaches
  • Child exploitation material or content harmful to minors
  • Copyright infringement or intellectual property violations
  • Network abuse, DDoS attacks, or interference with other users
  • Cryptocurrency mining on shared hosting resources
  • Harassment, defamation, or hate speech
  • Any activity that may damage our infrastructure or reputation

7. Resource Usage

For shared hosting services, you must use server resources responsibly:

  • CPU, memory, and bandwidth usage must not adversely affect other customers
  • We reserve the right to throttle or suspend accounts that consume excessive resources
  • Resource limits are specified in your service plan details

8. Data and Backups

While we implement reasonable backup procedures, you are ultimately responsible for maintaining your own backups:

  • We recommend regular backups of all your data and configurations
  • We are not liable for any data loss, corruption, or deletion
  • Backup restoration requests may be subject to fees

9. Termination

Either party may terminate this agreement:

  • By Customer: You may cancel your services at any time through your account dashboard or by contacting support
  • By SugarPage: We reserve the right to suspend or terminate services at any time for violations of these Terms or for any other reason at our sole discretion

Upon termination, you must immediately cease using our services. We may delete your data after a reasonable retention period.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability shall not exceed the amounts paid by you in the three (3) months preceding the claim
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for loss of data, profits, revenue, or business opportunities
  • We provide services "as is" without warranties of any kind, express or implied

11. Indemnification

You agree to indemnify, defend, and hold harmless SugarPage and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

12. Dispute Resolution

In the event of any dispute arising from these Terms:

  • The parties shall first attempt to resolve the dispute through good-faith negotiation for thirty (30) days
  • If negotiation fails, disputes shall be resolved through the appropriate courts in the Philippines
  • This agreement shall be governed by and construed in accordance with Philippine law

13. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through our website. Continued use of our services after such modifications constitutes acceptance of the updated Terms.
